Kit License, Disclaimer & Refund Policy

FIX256 Kit License, Disclaimer & Refund Policy: Version 1.0, effective October 21, 2026

1. Agreement. By purchasing or downloading a FIX256 kit ("Kit"), you ("Licensee") agree to these terms on behalf of the organization you represent.

1A. Reseller, licensor, payment and taxes. Lemon Squeezy is the reseller and merchant of record for your payment. It processes payment, calculates and collects any applicable sales tax, and sends your receipt, under its own buyer terms, which you accept at checkout. The Kit is licensed to you by FIX256 LLC under these terms. Prices are in U.S. dollars. Your purchase from Lemon Squeezy is a separate contract governed by Lemon Squeezy's buyer terms, including their governing-law terms. These terms govern only your license to use the Kit from FIX256 LLC.

2. License. FIX256 LLC grants Licensee a non-exclusive, non-transferable, perpetual license (subject to §6) to use, copy and modify the Kit for the internal business purposes of one Organization.

• "Organization" means a single legal entity (one EIN) and its owners, employees and contractors at any of its locations.

• Parents, subsidiaries, affiliates and other entities under common ownership each need their own license.

3. Advisors. Licensee may share the Kit with its outside IT provider, attorney, accountant or auditor solely to help Licensee. They may not use it for anyone else.

4. Restrictions. The following are not allowed without a separate written license:

• resale, sublicensing, redistribution or publishing;

• sharing outside the Organization;

• using the Kit, or anything derived from it, to provide services to third parties, including by MSPs or consultants.

5. Ownership. FIX256 owns all rights in the Kit. Licensee owns the information it enters, and may keep and use its completed documents permanently.

6. Termination. This license ends automatically if Licensee breaches §4 or receives a refund.

• On termination, Licensee must delete all unmodified copies of the Kit.

• A completed plan may be kept, unless a refund was issued.

7. Not advice; no certification.

• The Kit is educational material. It is not legal, tax, accounting or other professional advice, and not an audit, assessment or compliance certification.

• Using it does not make any organization compliant with any law, including the FTC Safeguards Rule, GLBA, IRS requirements or NY law.

• Laws change. Licensee is responsible for its own program and should consult a qualified attorney.

• Some Kits explain settings in third-party services (for example Facebook and Instagram). FIX256 is not affiliated with or endorsed by those companies. They control their own settings, policies and decisions, including account recovery, and may change them at any time. Kits are meant to help you reduce risk, but they don't guarantee security, availability or recovery of any account. You are responsible for changes you make to your accounts and systems.

8. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY. THE KIT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, AND WITHOUT ANY WARRANTY THAT USING THE KIT WILL MAKE YOU COMPLIANT WITH ANY LAW OR REGULATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIX256 LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS OR DATA, DATA BREACH COSTS, OR ANY FINES OR PENALTIES, ARISING OUT OF OR RELATED TO THE KIT OR ITS USE, AND FIX256 LLC'S TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID FOR THE KIT.

8A. No Professional Advice. The Kit consists of templates and general information only and is not legal, tax, accounting, or financial advice. No attorney-client, accountant-client, or other professional relationship is created. You are solely responsible for adapting the Kit to your practice and for your own compliance with applicable law, including the FTC Safeguards Rule (16 CFR Part 314) and IRC §7216. You should obtain advice from your own licensed professional before relying on it.

9. Refunds (14 days). If the kit isn't right for you, email info@fix256.com within 14 days of purchase for a full refund. This applies even if you've already downloaded the Kit. Please include your order number. We honor every refund request received within 14 days. Lemon Squeezy, as reseller and merchant of record (§1A), returns the refund to your original payment method. A refund ends your license (§6), and you must delete all copies. One refund per customer or organization. This refund is offered by FIX256 LLC in addition to any refund rights you have under Lemon Squeezy's buyer terms or applicable law. A written copy of this refund policy is available on request from info@fix256.com or FIX256 LLC, PO Box 216, Goshen, NY 10924.

10. Updates. Includes updates to the version you bought for 12 months from purchase. We may, but are not required to, provide later updates. A new major version may be sold separately.

10A. Delivery and download access. After payment you'll get a receipt email from Lemon Squeezy with access to your files. You can re-download them from Lemon Squeezy's My Orders page using the link in that email. Updates to the version you bought are delivered the same way. We don't guarantee download access will always be available, so please save a copy of your files. If you have trouble, email info@fix256.com.

11. Remedies. Unauthorized use may be stopped by court order (injunction). Licensee owes the then-current license fee for each unlicensed Organization, in addition to other remedies.

12. Law and venue. New York law applies. Exclusive venue is the state and federal courts for Orange County, New York (S.D.N.Y. for federal). Nothing here limits non-waivable consumer rights.
